In the 19 th century and before, people were suited and judged for personal features, social position, political interests and also by the fact, the crime itself commited. In this period, criminal justice turn to the person and not to the evidences and facts, becaming law suits less objetictives and more subjectives. In such context, the penalty goal was specially the punishment of the defendant. The criminal need do pay for his fault and generelly he did so with his freedom and body integrity.
